General / Validity of the GTC
By placing an order verbally, electronically or in writing, the following terms and conditions of sale, payment and delivery are recognized. These GTC apply to all orders for goods placed with Rex Metall AG, Schwarzenburgstrasse 564, 3144 Gasel (hereinafter referred to as Rex Metall AG). The GTC apply to every order in the version posted on the homepage at the time of the order. The GTC are subject to change at any time. Unless otherwise stated, the Swiss Code of Obligations (OR) shall apply.
Prices
Unless otherwise stated, prices are in Swiss francs (CHF / SFr.). Prices are subject to change without notice; prices are to be understood as take-home prices including Swiss VAT (unless otherwise stated), excluding shipping costs. The customer will be charged an additional delivery charge for each delivery. For further details see paragraph "Delivery and shipping". Deliveries abroad are made duty unpaid and without charging VAT. This is normally levied by the recipient country and charged directly to the recipient of the goods, possibly together with other import duties (customs, administrative expenses, etc.).
Conclusion of contract
All information on goods and prices on the Rex Metall AG website is subject to change and non-binding. By placing an order (verbally, by telephone, in writing by letter, fax, e-mail or via our web store), the customer submits a binding offer. If the goods ordered by the customer are not available in the desired quantity or at the specified price, Rex Metall AG shall inform the customer as soon as possible. In this case, the contract is only concluded when the customer confirms the order again under the changed conditions. Telephone orders are valid.
Delivery and dispatch
The goods are handed over personally (ex works, trade fair or market stand, etc.) or we send the goods worldwide by post, courier service or forwarding agent, depending on the size and weight of the delivery. The delivery time ranges from one day to several weeks, depending on the recipient country and the desired delivery method. Freight costs or shipping costs are borne by the recipient. These costs vary depending on weight, volume, destination and desired mode of transportation. Unless otherwise stated, we always ship goods at the most favorable rate (ECONOMY). Partial deliveries are permitted and no additional shipping costs will be charged. Complaints about partial deliveries do not entitle the buyer to refuse further delivery or the complete order. To the extent permitted by law, our obligation to pay compensation, regardless of the legal grounds, is limited to the invoice value. Rex Metall AG cannot be held responsible for delays in delivery and performance due to force majeure or events that make it significantly more difficult or impossible for Rex Metall AG to provide the service, such as strikes, official orders, etc. Rex Metall AG rejects any liability for delivery difficulties of goods that Rex Metall AG does not produce itself.
Reservation
Price, model, weight, material, size or color changes to our descriptions are reserved.
Damage
The goods are always sent at the risk of the recipient. On request and at the expense of the customer, goods transport insurance of the customer's choice can be taken out prior to transportation. In the event of damage during transportation, the recipient must immediately contact the carrier, the railroad or postal administration.
Goods / Returns / Guarantee / Complaints / Withdrawal from contract
Ordered and correctly delivered goods will only be taken back in exceptional cases and by prior agreement. The additional shipping costs as well as the processing/cancellation fee of 1/3 of the value of the goods, but at least CHF 10, shall be borne by the buyer. The cancellation fee is also due in the event of withdrawal from the contract before delivery. Products with clear manufacturing defects as well as consignments delivered incorrectly by us will be replaced by faultless or correct products free of charge after being returned to the customer. Unless otherwise stated, the statutory warranty period shall apply. Proof of purchase is always required to claim under the guarantee. In all cases, this is a "bring-in" guarantee. Damage to our products as a result of improper handling contrary to our instructions and recommendations on the product inserts and/or product labels is not covered by the guarantee. Complaints will only be considered within 8 days of receipt of the goods. The provisions of the Swiss Code of Obligations apply to hidden defects.
Payment
Deliveries are made against advance payment (transfer free of charge for us) or cash on delivery; in exceptional cases, a different method of payment may apply in accordance with a separate written agreement. Deliveries abroad also only against advance payment: credit card or advance payment to bank account (transfer free of charge for us), duty unpaid and uninsured.
We do not accept checks!
Default interest
If payment is more than 30 days overdue, interest on arrears will be charged (the month in arrears is considered to be a whole month).
Ownership
The goods remain the property of Rex Metall AG until final payment has been made.
Law and place of jurisdiction
All contracts concluded with Rex Metall AG are subject to Swiss law. The place of jurisdiction for both parties is exclusively Bern (Switzerland).
